Upwend is a recovery support companion developed and operated by ClearStep LLC, a company incorporated in the State of Illinois. Upwend is designed to support engagement in recovery between appointments.
Upwend is not a medical device, treatment program, clinical service, or crisis support service. It does not diagnose, prescribe, treat, or direct medical care. It is not a substitute for professional medical advice, clinical treatment, or the judgment of a licensed healthcare provider.
To use Upwend you must:
Access to Upwend is currently available through participating organizations only. The app is not currently available for direct consumer sign-up. If you do not have an access code, please speak with your program or clinician.
To access Upwend you will create an account using your email address and the access code provided by your participating organization.
You are responsible for keeping your login credentials secure. You must not share your account with anyone else.
If you believe your account has been accessed without your authorization, please contact us immediately at admin@clearstepapp.com.
ClearStep LLC reserves the right to suspend or terminate accounts that violate these Terms & Conditions.
Upwend is provided for your personal, non-commercial use as a recovery support companion. You agree to use the app only for its intended purpose and in accordance with these Terms & Conditions.
You agree not to:
Upwend provides general recovery support content grounded in evidence-based recovery-support frameworks. It does not provide medical advice, clinical diagnosis or treatment recommendations.
Nothing in Upwend should be relied upon as medical advice. Always consult your clinician, counselor or another qualified healthcare provider regarding your health and treatment.
All content within the Upwend app—including text, graphics, characters, stories, mini-games, recovery-support frameworks and design—is the intellectual property of ClearStep LLC and protected by applicable copyright and intellectual property laws.
You may not reproduce, distribute, modify or create derivative works without express written permission from ClearStep LLC.
Your use of the app does not grant you ownership of any Upwend intellectual property.
Your use of Upwend is governed by our Privacy Policy, which is incorporated into these Terms & Conditions by reference.
Upwend is designed to minimize collection of personal data and not to collect medical records or other protected health information through the app workflow. Program reporting is intended to be provided at an aggregate level rather than as reports of individual patient responses.
Upwend may use third-party providers for hosting, analytics and related services. These providers operate under confidentiality obligations consistent with our Privacy Policy.
ClearStep LLC is not responsible for the privacy practices or content of third-party services.
Upwend is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
We do not guarantee uninterrupted availability, freedom from errors or security vulnerabilities, or that use of the app will produce any specific outcome.
To the fullest extent permitted by law, ClearStep LLC and its officers, directors, employees and agents shall not be liable for indirect, incidental, consequential or punitive damages arising from the use—or inability to use—the Upwend app.
ClearStep LLC's total liability shall not exceed the amount paid for access. As patients do not pay directly for access, this amount is zero.
Nothing in these Terms limits liability that cannot legally be excluded.
You agree to indemnify and hold harmless ClearStep LLC and its officers, directors, employees and agents against any claims, damages, losses or expenses arising from your use of the app or violation of these Terms.
ClearStep LLC may modify, suspend or discontinue any part of the app at any time without notice.
We may also update these Terms & Conditions. Continued use of the app after changes become effective constitutes acceptance of the revised Terms.
You may stop using Upwend at any time.
ClearStep LLC may suspend or terminate your access with or without notice if these Terms are violated or for any other reason at our discretion.
Provisions relating to intellectual property, disclaimers, limitation of liability and governing law shall survive termination.
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Illinois.
These Terms & Conditions together with the Privacy Policy constitute the entire agreement between you and ClearStep LLC regarding your use of the Upwend app and supersede any prior agreements or understandings.
